1.1. Welcome to CatRadar

Welcome to CatRadar! We're really glad you're here. CatRadar is operated by KattenRadar, a Vennootschap onder Firma, registered under the Dutch chamber of commerce (KVK-nummer: 85677353), headquartered at Victorieplein 27 A 1, 1079KM Amsterdam.

1.2. Agreement to Terms

By accessing or using our services, you're agreeing to these Terms of Service, our Privacy Policy, and our Refund Policy. Please read them carefully before you begin using CatRadar services. If you don't agree to these terms, you may not use our services.

We may modify these terms from time to time. If you have an active search with us, we'll notify you of changes to our terms. We recommend users to review these terms before every purchase. If you continue to use the services after we've posted modified terms, it indicates that you agree to the modified terms.

2. Eligibility and Account

You must be at least 18 years of age to use our services. By using our services, you are affirming that you are at least 18 years old.

To use our services, you might need to create an account. You agree to provide accurate, current, and complete information during the account creation process. We will not provide a refund or change any inaccurate information if it was due to your fault.

3.1. Data Collection

We collect your email, phone number, your cat's name, your cat's photo, and other details necessary to initiate a search for your cat. Some information is mandatory, while others are optional. We use cookies for standard purposes like Google Analytics, Hotjar, Tag Manager, Facebook Ads, and more. First-party cookies make our website easier for you to use by facilitating immediate sign in and remembering your search details.

3.2. Use of Data

Your data is precious to us, and we handle it with utmost care. We use the collected data to enhance your user experience, optimize our services, and assist in your cat's search. Rest assured, any data shared online is to aid in finding your cat and we do not sell or trade your personal data with third-party companies for marketing purposes.

To protect your data, we employ industry-standard security measures. Your data is stored on secure servers, and we constantly work on enhancing our security protocols. However, please be aware that no method of transmission over the internet, or method of electronic storage, is 100% secure.

We strive to be fully compliant with the General Data Protection Regulation (GDPR). We respect your rights to access, rectify, and erase your personal data, among other rights stipulated by GDPR. In the event of a data breach, we commit to notify our users as per the regulations.

4. CatRadar Services

4.1. Description of Services

As outlined in the Introduction, CatRadar provides several services, including targeted digital ads, a missing poster with a QR code, a real-time search dashboard, and personal support.

4.2. Changes to Services

We are continually striving to improve our services, which may require us to change, suspend, or discontinue aspects of our services. In the case of material changes, we will provide you with advance notice when reasonably possible.

5. User Conduct

5.1. Acceptable Use

We trust that you will use our services responsibly, with respect and consideration for our community. Sharing false information, spamming, harassing, or any form of misuse of our platform is not acceptable.

By submitting User Content on or through the Service, you grant CatRadar a worldwide, non-exclusive, royalty-free, fully paid, sublicensable and transferable license to use, copy, modify, distribute, publicly display and perform, and otherwise exploit the User Content for the purposes of operating, providing, and improving our Service, and for our promotional purposes.

6.3. User's Rights and Responsibilities

You retain all your rights to any User Content you submit, post or display on or through the Service. By posting, you represent and warrant that you own or have obtained all necessary rights to such content.

6.4. Request to Cease Use of Content

Upon your reasonable request, CatRadar will make good-faith efforts to cease using your User Content for promotional purposes. However, you acknowledge that it may not always be possible to completely remove this content from the platform, particularly if it has been shared or otherwise disseminated by other users.

7. Dispute Resolution

7.1. Initial Dispute Resolution

If a dispute arises between you and CatRadar, we strongly encourage you to first contact us directly to seek a resolution by contacting info@catradar.com.

7.2. Agreement to Arbitrate

In the event we cannot resolve a dispute, we each agree to resolve any claim, dispute, or controversy through binding arbitration.

7.3. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands. Any dispute resolution proceedings will be conducted only on an individual basis and not in a class or representative action.

8. Intellectual Property Rights

8.1. CatRadar Intellectual Property

All intellectual property rights in and to the Service, including but not limited to the CatRadar logo, design, text, graphics, other files, and the selection, arrangement, and organization thereof are owned by CatRadar.

8.2. User Content and Intellectual Property

While you retain any intellectual property rights in your User Content, by posting or sharing content on the Service, you grant CatRadar a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media.
